1. ABOUT MY BUSINESS
1.1 This site and its contents belong to “Absolute Abstracts Lounge “and all its legal rights are reserved by the artist Sachin Dennis D’souza and are protected under The Trademark Act – 1999 & by Digital Millennium Copyright Act (www.dmca.com).
2. CONTRACTUAL UNDERSTANDING
2.1 It’s always a pleasure doing business with you, Therefore whenever you choose to place an order, that will demonstrate your interest and the intention of doing business with me which will involve monetary transactions, In such instances I shall connect with you over an e-mail confirming the status of your order and your payment at the earliest convenience possible.
Please note: It’s my understanding that by choosing to do business with me you are completely aware of and willing to agree to the terms and conditions as well as my privacy policies mentioned for the usage of my website, in case of any clarifications, please do feel free to get in touch with me at [email protected]
2.2 Upon confirmed payment transaction completion, I shall then begin to process your order also keeping you informed about the same, and at this point we have a contract between us, the deal is locked.
2.3 Please bear in mind that I give my best effort to feature all my paintings in my website with a great resolution quality image displaying every colours or textures as precisely possible captured with the help of professional mirrorless DSLR camera, However I do not take responsibility of how your display / monitor reflects the colour and tones of my paintings neither do I take accountability of its technical drawbacks.
There could be a slightest of differences as all of the paintings are hand painted and viewing an image on a digital platform such as the computer / mobile screen might cause some slightest amount of distortion in colors with a very least impact of viewing experience when you actually see the painting in real, A lot of time the impact of how art can project on your wall also depends on many other factors such as the type of frames used, the amount of light being projected on the painting, the size of the art or even where the painting is mounted, all these factors do contribute in the overall beauty the painting could bring out in your home and on your walls.
3. THE APPROACH OF BUYING MY ART
3.1 The following are the approaches you could take in order to purchase art from me,
a. In my website, Under the painting menu, navigate to your most desired size you wish or prefer to buy (i.e. Large, Medium, Small, Miniature), Explore from the available collections and click on the desired painting thumbnail to further access the product details, Fill in the product enquiry form to express your interest, We will get in touch with you at the earliest attending to your query or your interest for purchase.
b. Feel free to get in touch with me if you wish to customize a painting as per your requirement, please fill in the request form with required details and your message which will help me understand your expectations so I can work on it accordingly, and if need be, You and I could interact further to get a little bit more details about your customization preferences.
c. Alternatively, you could also reach out to me on ( + 91 99454 23223 / + 91 99454 99644 ) my mobile to discuss on the product you wish to buy from the existing list of items (WhatsApp internet calling would be a cost-effective idea or you could even text me)
3.2 Shipping charges would be communicated to you as needed once you’ve chosen on the painting that you wish to buy.
3.3 You are required to pay for the product in complete sum or amount while placing the order.
3.4 We use a PayPal & Bank transfer as a mode of payment. You could choose to transact through your Visa, Mastercard, American express (credit / debit cards) via PayPal payment gateway. We also accept Google Pay (Gpay) for our domestic customers and International online money wire transfers too ( Bank details will be provided to you accordingly )
3.5 Generally, The import charges are applicable based on the country you live in, Though Paintings & Sculpture are usually rated zero ( HSN code 9701 in India for exporting art worldwide), Yet if charged import duty by the customs, It’s completely your responsibility and in no sense will be liable to the Artist.
3.6 Upon completion of your order, you shall be notified over an e-mail regarding your date of dispatch and other relevant information, the product will reach you anytime between 8-14 business days from the dispatch date, However through the order number you should be able to track the status of your order conveniently.
4. SHIPMENT & DELIVERY
4.1 The order will be dispatched from my studio within 10 – 15 working days.
4.2 Please bear in mind that the domestic shipment (anywhere in India) will reach you anytime between 3 – 5 working days and the overseas shipment will reach your destination between 8 – 14 working days from the time the product has been dispatched.
4.3 Your product(s) will be delivered at the shipping address you had provided to us at the time of placing your order and you are expected to be present at the location point to collect your delivery which will normally be during the working hours of the logistic services that your product would be handed over by, however if for some reasons during your absence if the logistics staffs are instructed by you to hand over the product to someone who could collect it on your behalf or to keep the product unattended in a place till you are back, in such instances I will not take any responsibility for the loss or the damages incurred, you are requested to plan your schedule accordingly.
4.4 Clearing all the packaging material should be your disposal responsibility.
4.5 After one or more attempts to deliver your products by the logistics team if for some reason you are unable to collect the order personally then generally the logistic teams return the parcel / goods back to where it was shipped from, i.e. Back to my Studio, In such instances I reserve the rights to re-deliver the product to at an additional cost.
4.6 At any point if there’s a last-minute change in the delivery address, please do notify me before the order is dispatched so I could accommodate the change accordingly. If not, I reserve the rights to charge you an additional cost for having redirected the delivery by our logistic team.
4.7 Please make time to thoroughly inspect the product once they are delivered just to ensure there are no damages incurred and the product has reached you safe and sound. In case if you happened encounter any damages, please bring it to my attention at the earliest possible ( within a reasonable time ) also keep the delivery driver updated about the same, and likewise if the product is lost or damaged during the transit please do let me know accordingly too.
4.8 It’s always my sincere attempt to be at your service within the prompt and promised timelines, however having said that some situations are beyond my control and there could be instances where in there could be an unintentional delay in delivering the goods on time due to reasons such as commercial hiccups from the logistic team, natural calamities, indefinite nationwide lockdowns, Pandemic scenario etc. In such situation I request you to demonstrate your kind cooperation and complete understanding about my helpless situation.
4.9 For domestic / interstate orders (within India), The artwork will be shipped stretched in deep edge timber stretcher bars along with a hook and a string. The painting will be ready to hang, however you could even choose to exclude the option of using the strings and directly have it mounted on the set of screws on the wall, that is completely your preference.
4.10 All international orders will be shipped rolled securely packed in a tube.
5. CANCELLATION & RETURNS
5.1 You can decide on cancelling your order anytime within 10 calendar days from the time of delivery, if you wish to do, please drop in an e-mail stating the same, reasons for cancellation is not mandatory at all however if could wish to specify in your own terms that could work as feedback and help me improve my services to all my customers.
Please note: Kindly examine the product thoroughly or maybe think over it again all the way till 10 calendar days before you completely make up your mind on cancelling the order, just in case if you wish to change your mind.
5.2 As specified above, the deadline for returning the product post cancellation will be 10 calendar days, and the product has to be packed in it’s original condition as it was delivered to you at your own expense, please apply additional precautionary measures while packing the goods in order to protect them against being damaged.
5.3 In case if you are unable to return the goods / product to the logistic facility, I shall try and arrange for a pick-up ( if possible ) at an additional cost instructing the package carriers to do the same, a pre-requisite conditions for arranging a pick-up from your point is someone in-charge should handover the goods back to the logistic team, The logistic team will mostly be coordinating the time of pick-up with before ending up at your point.
Disclaimer : Most importantly, you are strictly requested to take a good care of the product with no damages or deterioration caused, and if failed to do so that will end up resulting in reduction of value depending on the extent of the damage, for example if the damages are minor in nature then the reduction in value will be 50%, but if the damages are major, you will not qualify for a refund. This is at sole discretion of the artist.
5.4 The refund would be initiated and processed within 30 calendar days from the time the returned product has reached back into my studio. Once the product is received it will be thoroughly checked, if the product is not in its original condition the return will not be accepted and the refund will not hold good in such scenario’s, therefore conditions apply.
5.5 Last but not the least, the above cancellation policies holds no good for corporate & business customers.
6. FAULTY GOODS
6.1 In case the product turns out to be faulty, do get in touch with me at your earliest convenience over an e-mail describing the actual issue in detail along with photographs to justify the claim, sharing a few pictures about the actual issue can save up all the efforts of returning the goods for inspection purpose.
6.2 If you wish to go for an exchange, i.e. different product(s) of a same size / price, that can be arranged once the original product has reached my studio and has completed all necessary inspections and checks, The initial cost of returning the product will be the responsibility of the customer, however post thorough inspection if the goods were found genuinely faulty, I shall refund your postage and handling charges completely along with an exchange of your choice.
6.3 Post inspection, if the exchanged product is not found faulty or damaged, then it will be sent back to you with an additional cost which will be borne by the customer.
HANDLING & CARE
Art / Paintings / Sculptures are very fragile in nature which will require quite an amount of careful and matured way of handling, following are the precautionary measures that are always good to be kept in mind:
a. Please avoid keeping them in extreme temperatures, i.e. extreme sunlight, dusty environment etc.
b. Refrain from spilling spirits, alcohols or any other forms of harmful liquids
c. Refrain from using dyes or non-recommended components for cleaning the product.
d. Additionally, refrain from scratching the canvas / surface with sharp objects such as knives, needle or another pointed object which could result in damaging the painting.
e. Please do not crumble the canvas which could lead the paint pigment from being cracked or peeled off.
f. Refrain from washing the painting with soap water or any other cleaning product, it could lead to unexpected negative chemical reactions.
g. Do not lean the painting towards any pointed object which would result in either a dent on the canvas or a portion of the canvas being ripped/torn off.
h. Do not keep any heavy objects on the painting which may lead to sagging of the canvas even while it is stretched.
i. Also, please keep a good presence of mind in dealing with fragile items to avoid causing any sort of an unexpected damage which we may not have expected to happen.
Special Mention : Please bear in mind that during the return process at any given situation if the painting is found abused with any of the above scenario’s or has been manhandled by the customer it will not be qualified for a return or even be considered as a damaged goods.
